
First Blood... for Federal Agencies
They drew first blood not me! The Supreme Court just dropped a ruling hotter than a walk through a field of punji sticks. Seems like Trump wanted to unload some folks from the National Labor Relations Board (NLRB) and Merit Systems Protection Board (MSPB) like Gwynne Wilcox and Cathy Harris. Court said 'Hold your horses Donny. You can fire these two but messing with the Federal Reserve? That's a different war.' They claim the Federal Reserve is some 'uniquely structured quasi private entity.' Quasi private? Sounds like some fancy talk for 'hands off!' Maybe they need a lesson on how things work out here.
Trump's Termination Tango
So the court is saying Trump can give these NLRB and MSPB folks the boot while their lawsuit hangs in the air like a bad smell. A federal judge tried to stop him but the Supreme Court said 'Nah let the man dance.' It's like telling a soldier he can't use his knife... then sending him into the jungle. Makes no sense right? But hey that's Washington for ya a whole different kind of warzone.
Executive Power: A Loaded Weapon
The majority opinion is all about 'executive power' and how the President can yank officers who use that power on his behalf. But as they say 'Careful what you wish for you might get it.' This opens a whole can of worms. Makes you wonder who's really in control? It's like handing a kid a grenade... eventually someone's gonna get hurt.
Powell's Standoff: No Surrender!
Now Federal Reserve Chairman Jerome Powell's been catching flak from Trump. But Powell ain't backing down. He said he wouldn't resign even if Trump asked. 'Not permitted under the law,' he declared. Good for him! Stand your ground. Don't let anyone push you around. That’s how you survive out there. Just like I told Murdock: 'Nothing is over!'.
Kagan's Dissent: A Lone Wolf Howl
Justice Elena Kagan and her crew didn't buy what the majority was selling. She said Trump has 'no legal right to relief' and that these board members are protected from presidential firing except for 'good cause.' She even called out the majority for making an exception for the Federal Reserve out of thin air. Sounds like someone wasn't happy with the game plan. Happens all the time; you gotta trust your gut. Maybe they should've called me in for backup.
The Federal Reserve: Untouchable Fortress?
Kagan thinks the Federal Reserve's independence is built on the same foundation as other agencies. The court basically pulled a rabbit out of its hat to create a 'bespoke Federal Reserve exception.' Why? To reassure the markets she says. But she think its a load of bull. If they needed reassurance they should have let the other ruling stand. Now they are just going to start calling things exceptions its easier. It's like trying to fix a helicopter with a toothpick. Sometimes the simple solution is the best solution. Like when I just needed to get across the border; Sometimes you just have to trust what you know.
