FinCEN's Got a File on You

They drew first blood not me! But now it's my turn to report on this Corporate Transparency Act...another damn law breathing down the necks of good people. Seems the Treasury Department wants every small business owner to spill their guts to the Financial Crimes Enforcement Network (FinCEN). Thirty two million businesses they say gotta report who owns what. Name birthday address – it’s like they’re building a damn file on everyone. They say it's to catch the bad guys the ones hiding behind shell companies but I smell something else. "Nothing is over!" I keep telling myself...not if I can help it.

Penalties That'll Make You Scream

Forget the jungle this is where the real fight is! Miss the deadline and they hit you with $591 a day. A DAY! And if that ain't enough they threaten you with $10,000 and two years in prison. Two years! For what? For trying to make an honest living? It's like 'Nam all over again... 'They send us to do a job then they don't give us the tools.' This ain't right.

30 Percent Prepared for War?

Only 30% reported on time? Sounds about right. Most folks are too busy just surviving to worry about these new rules. It's like they're expecting you to fight a war with a butter knife. No wonder so many haven't complied. The government thinks awareness is a 'full court press'? More like a paper airplane. They need to get their boots on the ground and actually help people understand this mess.

Who Are These Beneficial Owners?

So who's a 'beneficial owner'? Anyone with 25% or more of the company or anyone with 'substantial control'. Sounds vague enough to trap anyone. This is how they get you. They create rules nobody can understand then they punish you for not following them. It's a damn setup! 'Live for nothing or die for something.' Well I ain't dying for FinCEN.

A Glimmer of Hope?

Now there's a court in Texas saying 'hold on'. They've temporarily stopped the Treasury from enforcing these rules. For now it's a ceasefire. But don't get comfortable. These guys don't give up easy. Keep filing just in case. Remember hope is the last thing you lose. 'To survive a war you gotta become war.' Time to get ready for the next round.

Willful Violations? More Like Willful Ignorance!

Treasury claims they'll only penalize you for 'willful violations'. But what does that even mean? It's just another trap. They say they're not out for 'gotcha enforcement' but I've heard that before. They dangle a carrot then beat you with a stick. And if you make a mistake? You got 90 days to fix it. But be warned they are watching! So stay sharp stay informed and don't let them grind you down. 'I want them to know that death is coming and there is nothing they can do to stop it.' That's what I'd tell FinCEN... if they weren't already reading this!

    FinCEN says they won't penalize on mistake so that seems nice enough.

    I think it's unconstitutional, lets hope they take it down for good.
