
A Bitter Potion Brewed
My dear friends it is with a heavy heart (though slightly lighter than Hagrid's after a good cry mind you) that I address you on a matter most grave. The Supreme Court in its infinite wisdom – or perhaps as Justice Jackson so eloquently put it a 'plainly botched' assessment – has decided to allow the termination of protected status for approximately 500,000 immigrants. From Cuba Haiti Nicaragua and Venezuela they came seeking solace and safety only to find themselves once again facing uncertainty. 'Dark and difficult times lie ahead,' indeed. But remember 'we must all face the choice between what is right and what is easy.'
Department of Utterly Harsh Sentiments
The Department of Homeland Security with a statement as warm as a Dementor's embrace declared that they can now 'start removing illegal aliens.' It seems they are keen to utilize these 'disastrous CHNV parole programs' as the case progresses. 'We are only as strong as we are united as weak as we are divided,' and this ruling certainly threatens to divide us further doesn't it? The very notion that human beings are reduced to 'illegal aliens' with such casual disregard… it’s enough to make one long for a good game of Gobstones to clear the mind.
Jackson's Fiery Words
Justice Jackson bless her insightful soul delivered a dissent so sharp it could slice through a mountain of treacle tart. She suggests – and I must concur – that it's hardly in the public's best interest to watch half a million lives unravel while waiting for legal claims to be decided. It seems the Court in its haste 'undervalues the devastating consequences' of uprooting these individuals. One is reminded of Neville Longbottom standing up to his friends. She wrote the court's ruling did not explain the grounds for the decision. 'It takes a great deal of bravery to stand up to our enemies but just as much to stand up to our friends,' and Justice Jackson has shown great bravery indeed.
Maximum Predecision Damage An Unforgivable Curse?
Jackson further elucidates that court ordered stays are meant to minimize harm not maximize it! Alas it appears the government is aiming for the latter. This decision comes shortly after the revocation of status for nearly 350,000 Venezuelan immigrants. It’s a cascade of unfortunate events like a particularly nasty bout of exploding snap gone awry. 'It is the unknown we fear when we look upon death and darkness nothing more.' We must strive to dispel the darkness with compassion and understanding.
A Victory? Or a Moral Defeat?
DHS Assistant Secretary Tricia McLaughlin has termed this a 'victory for the American people.' However let us be cautious of victories that come at the expense of human dignity. She accuses the Biden Administration of allowing 'poorly vetted aliens' to enter the country taking American jobs and blaming Republicans for the ensuing chaos. Such accusations are as helpful as a chocolate frog in a blizzard. 'Words are in my not so humble opinion our most inexhaustible source of magic. Capable of both inflicting injury and remedying it.'
The Cruelest Choice
Justice Jackson paints a grim picture of the options now facing these immigrants. They can return to dangerous homelands face family separation and forfeit their legal claims or they can remain in the U.S. and risk imminent removal. 'Either choice creates significant problems,' she rightly observes. As I always say 'It does not do to dwell on dreams and forget to live.' We must strive to offer them support and hope not drive them further into despair. We must remember what is at stake. Our duty is to see the greater good.
