A David and Goliath Story But With More Paperwork
Well folks Captain America here reporting for duty! Turns out even in the 21st century some battles are fought in courtrooms instead of on battlefields. Cigna's taking on Bristol Myers Squibb claiming they've been playing dirty pool with their cancer drug Pomalyst. Now I'm no lawyer but when I hear 'sham lawsuits' and 'monopoly,' my shield starts to tingle. Reminds me of HYDRA trying to corner the market on world domination… or maybe just bad real estate.
Patent Pending… or Just Plain Shady?
Apparently Bristol Myers' Celgene unit is accused of filing bogus lawsuits to keep generic versions of Pomalyst away. And get this – Cigna claims they didn't even tell the Patent Office about some Boston doctor's patent! That's like me forgetting to mention I had a super soldier serum running through my veins when I signed up for the army. Honesty people! It's like Peggy always said 'Compromise where you can. Where you can't don't. Even if everyone is telling you that something wrong is something right. Even if the whole world is telling you to move it is your duty to plant yourself like a tree look them in the eye and say 'No you move.'
Ka Ching! The Sound of Overpriced Medication
Cigna's saying Bristol Myers 'willfully maintained monopoly power' over Pomalyst causing them to overpay by 'many hundreds of millions if not billions of dollars.' Billions! That's enough to fund a whole new fleet of Avengers Quinjets… or you know actually help people afford life saving medication. It's like Tony Stark using his genius to build bigger and better weapons instead of oh I don't know solving world hunger. 'With great power comes great responsibility,' as someone far wiser than I once said... wait wrong universe.
Deja Vu All Over Again?
Now this isn't the first time someone's taken a swing at Bristol Myers over Pomalyst. Blue Cross Blue Shield of Louisiana tried something similar but a judge dismissed the case. Looks like Cigna's hoping to have better luck this time around. Maybe they should consult with Daredevil; he seems to know his way around a courtroom... and the shadows. And maybe they should consult with me! I know how to take down big bullies.
The High Cost of Hope: A Grim Reminder
Let's not forget what's at stake here: Pomalyst treats multiple myeloma a blood cancer with no known cure. The five year survival rate is around 62%. These aren't just numbers; these are people’s lives. And when companies put profits ahead of patients well that's something I just can't stand for. It reminds me of when the Red Skull was trying to sell super weapons instead of trying to preserve peace. And we all know how that ended up for him.
Stay Tuned True Believers!
So there you have it folks. Another day another battle against corporate greed. I'll be keeping a close eye on this case making sure justice prevails. Because in the end it's not about the money; it's about doing what's right. Excelsior! Or as I like to say 'I can do this all day.'
